This page is to inform My Beach Mobile (“MBM” or “we”) users about the collection, use, and disclosure of information that identifies or can be used to identify you (“Personal Information”) when you use MBM’s mobile application and website and other online products or services that link to this Privacy Policy (collectively, the “Services” or “Service”).  We may partner with third parties, including Stripe or an affiliated Municipality, to provide you with additional services, products, promotions, or other experiences.  The relevant third-parties’ privacy policies, available on their websites, will apply to the collection of your Personal Information, in addition to this Privacy Policy.

Information Collection and Use

For a better experience, while using the Service, MBM may require you to provide and collects certain Personal Information.  The Personal Information obtained will be retained by us and used as described in this Privacy Policy.  Some examples of the Personal Information collected will and may be: your device Internet Protocol (“IP”) address, your device International Mobile Equipment Identity, your device name, your device operating system and its version, the configuration of the app when utilizing our Service, the time, location, and date of your use of the Service, your credit card information, your email, your name, any information you elect to provide to MBM, wifi or cellular connections, cookies, web beacons, and other statistics.  MBM collects this Personal Information only to provide the Service.

MBM may also obtain information from other sources. These sources vary over time, but could include service providers to determine a general location based on your IP address in order to tailor our service and for other uses consistent with this Privacy Policy; security service providers who aid us in securing our systems, preventing fraud and protecting our account security; payment service providers who provide us with payment or balance information, or updates to that information, based on their relationship with you; data providers from which we obtain aggregated demographic, interest-based and online advertising-related data; publicly available sources such as posts on social media platforms and information available through databases associating IP addresses with internet service providers (ISPs).

MBM uses the Personal Information to provide, maintain, and improve its Service.  We also may use the information we collect to: communicate with you about updates, technical notices, security alerts and support and administrative messages and to respond to your questions, comments, and customer service requests; inform you of products, services, offers, and events that we and others offer, and provide news and information that we think will be of interest to you, including based on your general geographic location (where we can determine that); personalize and improve the Service and provide advertisements, content or features that match user profiles or interests; monitor and analyze trends, usage and activities in connection with our Service and personalize and improve the Service; process your payment; carry out any other purpose described to you at the time the information was collected; and other items necessary to provide you with the Service.

If you choose to use the Service, you agree to the collection and use of the Data and Information. MBM follows the regulations set forth in N.J.S.A. 56:11-1 to 56:11-55 and will not use or share your information with anyone except as described in this Privacy Policy.

Service Providers

MBM utilizes third-party companies, including Stripe and New Jersey municipalities, to provide the Service who will also have access to your Personal Information.  Note that these third-party companies are not operated by MBM, and these companies do not share the same Privacy Policy.  MBM has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party companies utilized by MBM.

Security

We use reasonable measures to safeguard your personal information against loss, theft and unauthorized access, use and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information. However, no data security regime can ensure complete security. Accordingly, we cannot guarantee the security of your personal information.

Your password protects your user account, so we encourage you to use a strong password that is unique to your Service account, never share your password with anyone, and always limit access to your computer, device, and browser,

Changes to This Privacy Policy

MBM may update our Privacy Policy from time to time. Sharing Your Information

In general, your personal information will remain with MBM, but we may share Personal Information about you as follows or as otherwise described in this Privacy Policy: with the municipality related to your purchase; with third-parties who help facilitate the transactions between the municipality, you, and MBM, including Stripe; with our legal or sales entities where necessary to fulfill a contract or precontractual measures, or where MBM have a legitimate interest in doing so (such as increasing sales or providing you with access to our Service, providing customer support, or content development) or a legal obligation to do so; in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company; or in seeking to increase the market territory of MBM through sales.

We and our service providers may disclose and otherwise use your personal and other information where we or they reasonably believe such disclosure is needed to (a) satisfy any applicable law, regulation, legal process, or governmental request, (b) enforce applicable terms and conditions of use, including investigation of potential violations of such terms, (c) detect, prevent, or otherwise address illegal or suspected illegal activities (including fraud), security or technical issues, or (d) protect against harm to the rights, property or safety of us, our users or the public, as required or permitted by law.

MBM does not sell Personal Information to third parties.

We retain your personal information only as long as necessary to provide you with the Service and for legitimate business purposes, such as complying with the law, maintaining the Service, making business decisions about new features and offerings, and resolving any disputes. We keep some of your personal information (e.g., account information) for the duration of your use of the Service. We may anonymize your personal information (so that it is no longer identifying) for research or statistical purposes.  You may delete your account any time through the Delete Account function on the application.   

Minors aged 13 to 17 may only use the service with the involvement, supervision, and approval of a parent or legal guardian.  Minors under 13 may not use the Service. 

MBM occasionally will update this Privacy Policy in response to changes in the law or the Service and will change the “Date Last Updated” reference accordingly.  Please check back here periodically for the latest description of our privacy practices. Continuing to use the Service after any such updates take effect will constitute your acknowledgement and acceptance of those changes. If you do not wish to acknowledge or accept any updates to this Privacy Policy, you may delete your account.
